Algunos Aportes y Comentarios a Partir del Nuevo Código Civil Argentino al Sistema de Fuentes del Derecho Agrario

El nuevo Código Civil y Comercial impacta en el derecho agrario al ser de aplicación supletoria y también por regular instituciones que, en cierta medida, afectan la producción o son de uso frecuente por parte de los productores. Determina unos principios generales y de interpretación que reflejan consecuencias también en la legislación especial. Surgen de sus disposiciones directas implicancias para los contratos agrarios regulados en la ley 13.246, para los atípicos o innominados y para otros que tienen en tipos definidos por el Código un esquema básico que luego se complementa con las particularidades de la actividad. También se regulan contratos que pueden potenciar la organización empresarial. El derecho de familia también toca la organización empresarial y, en particular, existen novedades para la afectación del campo, la atribución preferencial del establecimiento agropecuario y el carácter propio de las crías del ganado. Se obliga al empresario agrario a llevar contabilidad.
Otras novedades introducidas a modo de principio y de reconocimiento de fuentes propias en el derecho ambiental también siguen la línea que reconoce que todas las actividades productivas y el ejercicio de los derechos deben compatibilizarse con la tutela ambiental. Un punteo completo de todas las notas que pueden extraerse del nuevo código y que tienen repercusión en nuestra disciplina las he publicado recientemente. Para respetar el espacio otorgado, en esta oportunidad, sin embargo, sólo recuperaré aquellas más vinculadas con el sistema de fuentes e instituciones tradicionales de derecho agrario.
