A proposta do presente artigo é mobilizar a leitura de trechos da obra Law, Pragmatism and Democracy de Richard Posner, com o intuito de problematizar a presença de certo pessimismo neste escrito com relação à participação popular na política e o seu papel no fortalecimento das democracias contemporâneas. Para tal, criou-se um contraponto a este entendimento através de outros arsenais teóricos em especial estudos no campo da sociologia, na tentativa de enriquecer o trabalho e jogar luz sobre o tema, uma vez que a interdisciplinaridade traz uma maior abertura na própria área de produção do saber jurídico. A relevância do tema está em enxergar os limites do pragmatismo jurídico para o avanço de uma concepção de democracia aplicável à realidade brasileira.
