Princípios e Regras: Conceito e Interpretação pelos Tribunais

O presente artigo objetiva analisar a interpretação dos tribunais a partir do conteúdo normativo extraído do texto legal ouconstitucional. Para tanto, partiu-se da definição axiológica doconteúdo normativo através da análise e da definição dosprincípios e das regras por seu conceito, distinção e hipóteses decolisão entre as espécies normativas, calcado na ideia de que ainterpretação do Direito se dá a partir do caso concreto, sem o quea norma é vazia e apenas mera possibilidade de direito. Denota-seque princípios e regras são capazes de exprimir conteúdosnormativos que devem ser observados casuisticamente. Observase, na sequência, que norma não se compreende pelo textoinserido nos dispositivos, mas pelo seu conteúdo extraído a partirda interpretação sistemática dos textos normativos, semprevisando a mais eficaz e eficiente aplicabilidade dos preceitosconstitucionais. Elemento fundamental para o desenvolvimento dotrabalho é a distinção entre princípios e regras, seus conceitos,diferenças e hipóteses de solução pelo intérprete em caso deconflito. O conteúdo normativo daí advindo é harmonicamenteinterpretado no intuito de melhor concretizar os direitosfundamentais garantidos pela Constituição Federal, medianteponderação e a partir da situação posta em análise. Após análisede acórdãos julgados pelos Tribunais Brasileiros em casos dos ramos do Direito do Trabalho, Direito Tributário e DireitoPrevidenciário, demonstra-se o afastamento de regras clarascontidas no ordenamento jurídico de suas hipóteses de incidência,feitas pelo intérprete com a finalidade de melhor concretizar oDireito como Sistema completo e integrado a partir dos preceitosconstitucionais estruturantes da ciência jurídica.Downloads
