LEI N° 13.465/2017: ANÁLISES E REFLEXÕES SOBRE OS SEUS IMPACTOS NA POLÍTICA DE REFORMA AGRÁRIA BRASILEIRA

O artigo tem o propósito de analisar a Lei nº 13.465 de 2017, sancionada no governo de Michel Temer (PMDB), com o intuito de refletir sobre as principais ações e impactos que a respectiva lei trás para a política agrícola, bem como suas consequências aos povos do campo e camponeses que lutam pela terra. A metodologia utilizada para esta revisão de literatura é constituída de estudo bibliográfico e documental com a abordagem qualitativa de investigação e método de pesquisa indutivo. No primeiro tópico, foi apresentado o conceito sobre reforma agrária, função social da terra e desapropriação do imóvel rural, mostrando duas injustiças nas desapropriações, comenta sobre os governos Fernando Henrique Cardoso, Lula e Dilma em relação à reforma agrária e traz a ideia de quão difícil é esta tarefa de mudar questões estruturais conflitantes. O segundo tópico traz algumas das mudanças legislativas ocasionadas com a promulgação da lei nº 13.465/17 e os posicionamentos dos principais atores sociais em favor e contrário ao governo Temer, após a sanção da lei. No terceiro tópico existe a apresentação das ideias expostas em artigos e ações ajuizadas no setor judiciário sobre os impactos sentidos após a implantação da lei. Através do estudo percebe que tal lei foi imposta pelo governo articulado com os interesses de setores ligados ao agronegócio e ao latifúndio, gerando uma ampliação do mercado de terra, da concentração fundiária e da grilagem de terras o que provoca um esvaziamento na política de reforma agrária.Downloads
