A Regência Atual dos Contratos de Arrendamento Rural do Agronegócio pelo Estatuto da Terra

O presente artigo visa, a partir de uma leitura econômica do Estatuto da Terra, se valendo do método dedutivo, defender que a regência atual dos contratos de arrendamento rural do agronegócio é ainda feita pelo Estatuto da Terra, mesmo que as partes gozem de condições técnicas e econômicas consolidadas. A questão central aqui tratada é a discordância da decisão no REsp nº 1.447.082/TO, que afastou direitos previstos no Estatuto das empresas do agronegócio. Defende-se que a regência do arrendamento pelo Estatuto da Terra tem termo final preciso, a aprovação do novo Código Comercial (PLS nº 487/2013), que provavelmente revogará o Estatuto da Terra no que tange a regulamentação dos contratos agrários que façam parte do agronegócio. Por fim, são apresentadas e analisadas algumas das inovações trazidas pelo novo Código Comercial.Downloads
