(IN)OCORRÊNCIA DO ESVAZIAMENTO DO MODELO GARANTISTA DA CONSTITUIÇÃO FEDERAL DE 1988 COM O JULGAMENTO DO HABEAS CORPUS Nº 126.292 QUE RELATIVIZOU O PRINCÍPIO DA PRESUNÇÃO DE INOCÊNCIA

O Princípio da Presunção de Inocência é garantia basilar prevista no artigo 5º, inciso LVII, da Constituição Federal de 1988. Nesta, consta a premissa de que qualquer sujeito deve ser considerado inocente até o trânsito em julgado da sentença penal condenatória. Em Fevereiro de 2016, o Supremo Tribunal Federal entendeu, porém, de modo diverso ao julgar o Habeas Corpus nº 126.292 estipulando que é admissível a execução provisória da sentença penal condenatória, podendo qualquer acusado ser compelido a cumprir pena já em sede de segunda instância, mesmo que ainda estejam pendentes recursos ao Superior Tribunal de Justiça ou ao Supremo Tribunal Federal. Nesse contexto a pesquisa busca analisar a (in)ocorrência do esvaziamento do garantismo constitucional através do referido entendimento que relativizou o Princípio da Presunção de Inocência. O estudo realizou-se, portanto, partindo-se de uma análise histórica do princípio em comento, perpassando-se à análise da opinião dos Ministros da Suprema Corte, investigando quais motivos levaram esta a decidir pela possibilidade da execução provisória da sentença penal condenatória, conduzindo à prisão determinado indivíduo sem que haja o trânsito em julgado da sentença. Ademais, passou-se ao objetivo maior da pesquisa, qual seja, verificar a (in)ocorrência do esvaziamento do garantismo constitucional, analisando-se os postulados da Teoria do Garantismo Penal, bem como a aferição da transcendência do núcleo essencial do Princípio da Presunção de Inocência, observando, ainda, as consequências da técnica do Ativismo Judicial utilizado no julgamento do Habeas Corpus nº 126.292 para a (in)ocorrência do esvaziamento do garantismo. Concluiu-se, que de fato houve o esvaziamento do garantismo constitucional, tendo em vista que a decisão do Supremo Tribunal Federal transcendeu o núcleo essencial do Princípio da Presunção de Inocência e, por fim, extrapolou os limites impostos pelo ativismo judicial. Verificou-se, ademais, que a decisão que antecipou a prisão dos acusados, ainda que pendentes recursos às instâncias extraordinárias, não possui efeito vinculante, de modo que deve ser analisado em cada caso se seria cabível ou não a execução provisória da sentença penal condenatória.
